Palestinians ask Rome not to sign with Mekorot

Palestinian civil society organizations highlight that the proposed collaboration between Rome's water company ACEA and Mekorot amounts to a violation of that legal obligation and urge the authorities to follow the principled stand taken by your Dutch counterpart and ensure that ACEA does not contribute to violations of international law and human rights committed by Mekorot.

Dear Azienda Comunale Energia e Ambiente (ACEA) board members, Mayor Ignazio Marino and the Assemblea Capitolina,

 

Standing in full support of Italian movements for public water, we, the undersigned Palestinian civil society organisations, write to urge ACEA and its shareholders to heed the appeal issued by the Committee Against the ACEA-Mekorot Agreement and to ensure that the proposed cooperation between Mekorot and ACEA does not take place.

The agreement signed between ACEA and Israeli state water company Mekorot states that it aims to facilitate the exchange of experiences. We urge you to consider that the experience and expertise that Mekorot is able to share with ACEA has been developed as result of the pivotal role that it plays in the appropriation of Palestinian water. Any cooperation with Mekorot strengthens its ability to violate international law and human rights.

As Friends of the Earth International noted in a recent statement, Mekorot is the main Israeli body responsible for orchestrating and sustaining Israel’s control and theft of Palestinian water and the denial of the Palestinian right to water. Mekorot illegally appropriates Palestinian water and imposes severe obstacles to Palestinians accessing their own water. Amnesty International has accused Israel of depriving Palestinians of their access to water “as a means of expulsion”.

In the 1950s, Israel built Israel’s national water carrier, which is diverting the Jordan River from the Palestinian West Bank to serve Israeli communities. Since it took over the Palestinian water system in 1982, Mekorot has been cutting off the water supply to entire Palestinian villages and diverting water to illegal Israeli settlements. Today, Palestinian villages that are supplied by Mekorot face pressure to adopt prepaid water meters, making it even more difficult for them to access water.

Mekorot oversees the wilful wholesale destruction and pillage of Palestinian water infrastructure including the demolition of Palestinian water wells, the digging of wells that are so deep that they make Palestinian wells dry up, and the implementation of extortionate water prices for Palestinian communities. Palestinians in Gaza are forced to purchase water from Mekorot due to Israel’s medieval siege and the over-extraction of the Coastal Aquifer itself conducted by Mekorot.

Mekorot’s participation in the displacement of Palestinians is not limited to the occupied Palestinian territories. In the Naqab desert in the south of Israel, Mekorot denying access to water as a means of reinforcing Israeli policies designed to ensure the forced displacement of Palestinian Bedouins.

Dutch public utility company Vitens recently announced that its commitment to international law had led it to decide to to abstain from signing an international cooperation agreement with Mekorot.

According to a 2004 ruling of the International Court of Justice, state bodies have a legal obligation not to provide recognition or assistance to Israeli violations of international law. The proposed collaboration between ACEA and Mekorot amounts to a violation of that legal obligation. We urge you to follow the principled stand taken by your Dutch counterpart and ensure that ACEA does not contribute to violations of international law and human rights committed by Mekorot.

In pieno sostegno ai movimenti italiani per l'acqua pubblica, noi, sottoscritte organizzazioni della società civile palestinese, vi scriviamo per sollecitare l’Acea e i suoi azionisti ad accogliere l'appello del Comitato No Accordo ACEA – Mekorot e assicurare che la cooperazione tra Mekorot e ACEA non avvenga.

Nell'accordo siglato tra l’Acea e la società idrica statale israeliana Mekorot si afferma che esso mira a facilitare lo scambio di esperienze. Vi esortiamo a considerare che l'esperienza e le competenze che Mekorot è in grado di condividere con ACEA sono state sviluppate e sono la conseguenza del ruolo centrale che svolge nella appropriazione di acqua palestinese. Qualsiasi collaborazione con Mekorot rafforza la sua capacità di violare il diritto internazionale e i diritti umani.

Come ha rilevato Amici della Terra Internazionale in una recente dichiarazione[ https://stopthewall.org/2014/01/08/foei-statement-water-apartheid-palestine], Mekorot è l’ente israeliano principale e che porta la maggiore responsabilità nel programmare e sostenere il controllo e il furto dell'acqua palestinese da parte di Israele e la negazione del diritto dei palestinesi all'acqua. Mekorot si appropria illegalmente di acqua palestinese e ostacola fortemente i palestinesi nell’accesso alla propria acqua. Nel 1950, Israele ha costruito il National Water Carrier, un collettore che devia l’acqua del fiume Giordano dalla Cisgiordania palestinese per servire le comunità israeliane. Da quando ha assunto il controllo del sistema idrico palestinese nel 1982, Mekorot ha tagliato l'erogazione dell’acqua a interi villaggi palestinesi deviandola agli insediamenti illegali israeliani.[ https://www.alhaq.org/publications/Water-For-One-People-Only.pdf] Oggi, i villaggi palestinesi forniti da Mekorot sono pressati affinché adottino contatori d'acqua prepagati, cosa che renderà loro ancora più difficile accedere all'acqua.[ https://www.blueplanetproject.net/documents/RTW/RTW-Palestine-1.pdf]

Mekorot sovraintende alla deliberata e indiscriminata distruzione e al saccheggio delle infrastrutture idriche palestinesi, ivi compreso la demolizione di pozzi d'acqua palestinesi, allo scavo di pozzi così profondi che sottraggono acqua ai pozzi palestinesi prosciugandoli e all'applicazione di prezzi dell'acqua esorbitanti per le comunità palestinesi. I palestinesi di Gaza sono costretti ad acquistare l'acqua da Mekorot a causa dell'assedio medievale imposto da Israele e per l'eccessiva estrazione dalla falda acquifera costiera condotta dalla stessa Mekorot.

Il ruolo della Mekorot nel trasferimento forzato del popolo palestinese non si limita ai territori palestinesi occupati. Nel deserto del Negev, nel sud di Israele, Mekorot, attraverso il divieto dell’accesso all'acqua, rafforza le politiche israeliane che mirano alla deportazione forzata dei beduini palestinesi.[ https://www.internal-displacement.org/8025708F004CE90B/%28httpDocuments%29/6248B673A93BEFF3C12574120062611E/$file/COHRE+Submission+to+Goldberg+Committee+Feb-1.pdf]

La società idrica statale olandese Vitens ha recentemente annunciato che, stante il suo impegno per il rispetto del diritto internazionale, è arrivata alla decisione di astenersi dal firmare un accordo di cooperazione internazionale con Mekorot.[ https://www.bdsmovement.net/2013/dutch-water-company-terminates-relationship-mekerot-government-advice-11502]

In base alla sentenza della Corte Internazionale di Giustizia del 2004, gli Stati e le sue istituzioni hanno l'obbligo legale di non dare copertura o assistenza alle violazioni israeliane del diritto internazionale. La proposta di collaborazione tra ACEA e Mekorot equivale a una violazione di tale obbligo giuridico. Vi invitiamo a seguire la posizione di principio adottata dalla vostra omologa società olandese e a fare in modo che ACEA non contribuisca alle violazioni del diritto internazionale e dei diritti umani commesse da Mekorot.
